The solution to Arizona's immigration law lies in Democrats' hands
If the Democrats vilifying Arizona's new illegal immigration law were sincere, they could solve the problems of which they complain today. Harassment of minorities, racial profiling and invasion of privacy. These are just some of the Left's favorite accusations against Arizona's state legislature and governor for passing the recently enacted illegal-immigration law.
The solution, however, is easy and immediate...and it lies in the hands of the Democratic-controlled U.S. House of Representatives, Democratic-controlled U.S. Senate, and Democratic president: repeal section 1304(e) of Title 8 (Chapter 12) of the United States Code which reads:
(e) Personal possession of registration or receipt card; penalties
Every alien, eighteen years of age and over, shall at all times
carry with him and have in his personal possession any certificate of
alien registration or alien registration receipt card issued to him
pursuant to subsection (d) of this section. Any alien who fails to
comply with the provisions of this subsection shall be guilty of a
misdemeanor and shall upon conviction for each offense be fined not to
exceed $100 or be imprisoned not more than thirty days, or both.
The new Arizona law requiring law enforcement officials to make a "reasonable attempt...to determine the immigration status of the person" is the provision that has everyone on the Left up in arms. Repealing section 1304(e) of the federal law would render the new Arizona law meaningless and of no force or effect. If there is no longer any certificate of alien registration or alien registration receipt card (i.e., "Green Card") that anyone is required by law to carry, attempts to verify one's status on the street or at the point of arrest is no longer "reasonable" but difficult and unreasonable.
The Left must direct their complaints and demands for repeal of the Arizona law to their compatriots and fellow travellers in the Democratic-controlled Congress who can eliminate this problem tomorrow by repealing s. 1304(e) of Title 8 in the morning and have it on the President's desk for his signature by lunch...long before the legally prescribed date of implementation of the Arizona law slated for July.
